These Terms & Conditions (“Terms”) govern your access to and use of holidaysmakers.com (the “Website”) and the holiday packages, travel arrangements, and related services offered by Holidaysmakers.

By using the Website, requesting a quotation, or making a booking, you accept these Terms. Please read them carefully.

If you don’t agree with them, please don’t use the Website or our services.

1. Definitions

1.1 “Holidaysmakers”, “we”, “us”, “our” means Holidaysmakers Pvt. Ltd., trading as Holidaysmakers, with registered office at 7901 4TH ST N STE 300, ST PETERSBURG, FL 33702.

1.2 “You”, “your”, “the Customer” means the person making a booking or enquiry, and each traveller named in that booking.

1.3 “Package” means a holiday package or travel arrangement (which may include flights, accommodation, transfers, sightseeing, and other services) offered or arranged by Holidaysmakers.

1.4 “Supplier” means any third-party provider of travel services, including airlines, hotels, resorts, transfer and transport operators, destination management companies, tour and activity operators, and similar providers.

1.5 “Booking” means a confirmed reservation of a Package, or of any travel service arranged through Holidaysmakers.

2. Accepting and updating these Terms

2.1 These Terms, together with our Privacy Policy, Cookies Policy, and Cancellation & Refund Policy, form the entire agreement between you and Holidaysmakers in relation to your use of the Website and our services.

2.2 We may update these Terms from time to time. The version in effect at the time of your Booking applies to that Booking. Continued use of the Website after changes are posted amounts to acceptance of the revised Terms.

3. Eligibility

3.1 You must be at least 18 years old and have the legal capacity to enter into a binding contract to make a Booking. By booking, you confirm that you’re authorised to act on behalf of everyone in your party and that they accept these Terms.

4. Our role

4.1 Holidaysmakers arranges and coordinates travel services provided by independent Suppliers. Except where we expressly act as the principal provider of a service, we act as an intermediary between you and the Suppliers who actually provide the flights, accommodation, and other elements of your Package.

4.2 Each Supplier provides its services subject to its own terms and conditions, fare rules, and conditions of carriage, which may limit or exclude that Supplier’s liability to you. Those terms apply to your Booking in addition to these Terms, and you agree to be bound by them. We’ll make the relevant Supplier terms available to you on request.

4.3 We take reasonable care in selecting reputable Suppliers, but we don’t own, manage, or control them and aren’t responsible for their acts or omissions except to the extent set out in these Terms and required by applicable law.

5. Enquiries, quotations, and prices

5.1 Information on the Website, including itineraries, inclusions, and indicative prices, is provided for general guidance and may change. Quotations are valid only for the period stated and are subject to availability at the time of Booking.

5.2 Prices are quoted in US Dollars (USD) unless stated otherwise. Prices may be affected by availability, currency fluctuations, Supplier pricing, taxes, fees, and surcharges. The applicable price is the one confirmed at the time your Booking is made.

5.3 Unless expressly stated, prices don’t include personal expenses, optional activities, visa or travel-document fees, travel insurance, gratuities, or any taxes and charges payable locally.

6. Bookings and how a contract is formed

6.1 When you submit a Booking and the required payment, you make an offer to purchase the Package on these Terms and the applicable Supplier terms.

6.2 A contract is formed only when we confirm your Booking in writing (for example, by issuing a booking confirmation or travel documents). Until then, prices and availability aren’t guaranteed.

6.3 You’re responsible for checking that all details on your confirmation — including names (which must match travel documents), dates, destinations, and inclusions — are correct, and for telling us immediately about any error. Corrections after confirmation may incur Supplier charges.

7. Payment

7.1 Payment terms, including any deposit and the balance due date, will be advised at the time of Booking. Some Packages and fares require full payment at the time of Booking.

7.2 If payment isn’t received by the due date, we may treat the Booking as cancelled and apply cancellation charges in line with our Cancellation & Refund Policy and the relevant Supplier terms.

7.3 Payments are processed through secure third-party payment gateways. Payment-gateway processing fees may apply and are non-refundable, as further described in our Cancellation & Refund Policy.

8. Changes and cancellations you make

8.1 Requests to amend or cancel a Booking must be made to us in writing. Changes are subject to availability and to Supplier terms, and may incur amendment or cancellation charges.

8.2 Refunds, where available, are governed by our Cancellation & Refund Policy and the rules of the relevant Suppliers. Many travel services — including certain air fares and hotel rates — are non-refundable once confirmed.

9. Changes and cancellations we make

9.1 Occasionally we or a Supplier may need to change or cancel arrangements. Where a significant change is necessary before travel, we’ll let you know as soon as reasonably possible and, where practicable, offer you a suitable alternative or, where appropriate, a refund of the amounts we’re able to recover from Suppliers.

9.2 We aren’t liable for changes or cancellations caused by Force Majeure (Section 14) or by the act or omission of a Supplier, except as required by applicable law.

10. Travel documents, passports, visas, and health

10.1 You’re solely responsible for ensuring you hold a valid passport, visas, permits, and any health or vaccination documentation your trip requires, and that travel-document names match your Booking exactly.

10.2 We aren’t liable for any loss, denied boarding, denied entry, or additional cost arising from your failure to meet passport, visa, immigration, customs, or health requirements.

11. Travel insurance

11.1 We strongly recommend that you take out comprehensive travel insurance suited to your trip, covering (among other things) cancellation, curtailment, medical expenses, repatriation, and loss of baggage. Travel insurance is your responsibility unless expressly included in your Package.

12. Your conduct and obligations

12.1 You agree to comply with all applicable laws and Supplier rules during your trip, to behave responsibly, and not to cause damage, danger, or disruption. Suppliers may refuse service, and we accept no liability, where your conduct breaches this clause.

13. Liability

13.1 Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.

13.2 Subject to clause 13.1, Holidaysmakers isn’t liable for the acts, omissions, default, or insolvency of any Supplier, or for loss or damage arising from circumstances beyond our reasonable control.

13.3 Subject to clause 13.1, our total aggregate liability to you arising out of or in connection with a Booking shall not exceed the total amount of fees actually received and retained by Holidaysmakers in respect of that Booking (excluding amounts paid on to Suppliers and non-refundable charges).

13.4 We aren’t liable for indirect, incidental, special, or consequential losses, or for loss of enjoyment, profit, or opportunity, to the extent permitted by law.

13.5 The Website and its content are provided on an “as is” and “as available” basis. While we take care to keep information accurate, we don’t warrant that the Website will be uninterrupted, error-free, or free of harmful components.

14. Force majeure

14.1 We aren’t liable for any failure or delay in performing our obligations where caused by events beyond our reasonable control, including (without limitation) natural disasters, extreme weather, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, strikes, government action, border or airspace closures, airline or Supplier failure, and technical or transport disruptions (“Force Majeure”).

15. Intellectual property

15.1 All content on the Website — including text, images, logos, the Holidaysmakers name and branding, layout, and design — is owned by or licensed to Holidaysmakers and is protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

16. Indemnity

16.1 You agree to indemnify and hold harmless Holidaysmakers against any claims, losses, liabilities, and costs arising from your breach of these Terms, your violation of any law, or your infringement of any third-party right.

17. Complaints

17.1 If a problem arises during your trip, please notify the relevant Supplier and our team as soon as possible so we can try to put it right. If a matter remains unresolved, please contact us in writing at booking@holidaysmakers.com within a reasonable time of your return so we can investigate.

18. Governing law and where disputes are heard

18.1 These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws applicable in the user’s home jurisdiction

18.2 Before starting formal proceedings, the parties shall make reasonable efforts to resolve any dispute amicably through good-faith discussion.

19. General

19.1 Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in full force.

19.2 Waiver. A failure to enforce any provision isn’t a waiver of our right to do so later.

19.3 Assignment. You may not assign your rights under these Terms without our consent. We may assign or transfer our rights and obligations subject to applicable law.

19.4 Entire agreement. These Terms and the policies referred to in them make up the entire agreement between you and Holidaysmakers regarding their subject matter.
